General terms and conditions

Scope

The offer on the site www.kasparconsulting.de is a product of KasparConsulting GmbH, located at Sonnenbergstrasse 3, 3013 Bern, Switzerland.

The following General Terms and Conditions (GTC) apply to all events, training and further education (hereinafter referred to as "course") on the site www.kasparconsulting.de. It does not matter whether the course takes place online or physically, i.e. on site in the respective premises.

Registration and payment

Registrations for events must be made online or in writing by mail. The registration obliges you to pay the course fee. The entire participation fee must be paid within 30 days of the invoice date, but no later than 10 days before the start of the course. Payment in installments will not be accepted. The course fee must be paid in full.

Non-payment of the course fee does not count as cancellation!

Organization

For organizational reasons, we reserve the right to postpone or combine courses or to change the location. In case of cancellation of a course, KasparConsulting GmbH is entitled to change the course instructor.

Implementation of the courses

In order to conduct the courses under ideal conditions, a minimum and a maximum number of participants is set for each learning offer. Places on courses are allocated in the order in which registrations are received (subject to timely and full payment of course fees).

Course confirmation

At your request, we will be happy to issue a course confirmation. The condition is that your course must have taken place no longer than one year ago. We expressly reserve the right to make other arrangements for certificate and diploma courses.

Cancellations

Every registration is binding. Cancellations must be sent in writing to KasparConsulting GmbH, Sonnenbergstrasse 3, 3013 Bern. Please note that depending on the time of cancellation, we may waive the course fees in whole or in part.

Since course cancellations always involve some planning and administrative effort, the following regulations apply:

Cancellation date: From 29 to 10 calendar days before the start of the course: Cancellation fee: 50 % of the course fees
Cancellation date: From 9 calendar days before the start of the course. No waiver or refund of course fees. I.e. the full course fee must be paid.
Non-attended face-to-face or online courses, course days, or parts thereof
Non-attended face-to-face lessons cannot be made up and will not be refunded, nor will non-attended online lessons.

Termination of contract

KasparConsulting GmbH reserves the right to exclude one or more course participants from a course for cause: Course exclusion due to non-payment of the course fee as well as in case of serious misconduct on the part of the course participant (e.g. defamation, harassment, intentional damage to property, etc.). In the event of exclusion from the course due to the above-mentioned cases (the list is not exhaustive), no refund or waiver of the course fee will be made.

Disclaimer Liability and Insurance

KasparConsulting GmbH is not liable for any damages caused by events organized by KasparConsulting GmbH. Participants are solely responsible for ensuring that they have sufficient insurance coverage.

In particular, KasparConsulting GmbH cannot accept any liability for theft or loss of items when using the premises of third parties for classroom training.

Data protection

KasparConsulting GmbH will process all data received from you (e.g. when registering, during the course or in other circumstances), or which it has received about you in connection with this or which it has received from you in the past, with the utmost care and in accordance with the Swiss Data Protection Act (DSG) and the Data Protection Regulation (DSGVO) applicable in the European area. Data will only be passed on to external service providers under strict, contractual data protection conditions to external service providers in Switzerland or, if necessary, to law enforcement authorities due to legal regulations.

Price or program changes

Program and price changes as well as changes to the general terms and conditions are reserved at all times.

Place of jurisdiction

All legal relations with Kasparconsulting GmbH are governed by Swiss law, excluding the conflict of laws rules. The place of jurisdiction is Bern, the domicile of KasparConsulting GmbH.
